I chose to address these particular topics for a number of reasons. First, if convicted of a second-degree felony in Texas, you can receive anywhere from 2 to 20 years of prison time. Additionally, a second-degree felony charge can be combined with multiple charges relevant to the incident that could result in more substantial sentencing. Second, it is important to understand that prosecutors take an aggressive stance on all criminal matters involving sexual conduct with children. Third, robbery cases are complex and whether a robbery case is enhanced to first-degree is fact specific. Also, there are numerous defenses that can be presented relating to violations of the Fourth Amendment and laws regulating eyewitness identifications. Lastly, many of the same fact-specific issues are present in criminal charges involving arson.
