This is the first post in a series which will address the topic of handling gun-related charges in Austin, Texas. I am writing on this topic due to the serious consequences that attach to firearm related crimes. I cannot stress enough the fact that a criminal defense attorney should be contacted immediately if you or a loved one has been arrested. The sooner you contact counsel, then the sooner they may begin formulating your defense. I have been licensed since 1995 and am Board Certified in Criminal Law by the Texas Board of Legal Specialization. If you are in need of assistance, then call my office to speak with a lawyer.
I will be addressing a number of topics over my upcoming articles. Some of the issues which I will address include:
- How search and seizure issues impact firearm related charges
- The handling of federal “felon in possession” charges
- How the use of a gun can elevate the penalties for other crimes
I consider these important topics to address. First, it is not uncommon for a gun to be found through law enforcement’s violations of one’s Fourth Amendment rights. If such a violation occurred then, depending on the facts and circumstances of the case, it may be possible to gain a dismissal of the charges. Second, under 18 USC 922(g), it is a violation of federal law for one to possess a gun after having been convicted of a felony or domestic violence. The potential penalties for such a violation can be severe. Finally, the use of a firearm during the commission of any other offense can lead to serious consequences.
A point that I will be stressing throughout each of these articles is the need to immediately contact an attorney after an arrest. Counsel will launch an immediate investigation into the matter, will file any necessary motions, and will the steps necessary to ensure that your rights remain protected. Do not make the mistake of thinking that you are without automatically without options because you have been arrested. I believe that everyone is entitled to both quality representation and the highest levels of respect.
