A defendant may not receive probation, however, under Texas Code of Criminal Procedure 42A.001, if their sentence is for a period of ten years or longer. Third, it is important to discuss the types of defenses which may apply to different situations. Finally, understanding how to select a lawyer for a capital case is vital if your family member is facing the ultimate penalty.
