Man holding jail barsThis is the first post in a series of articles which will address the handling of felony charges in Austin and other Texas areas. I consider it important to address this topic as anyone who faces such charges can potentially spend time in prison. By understanding the nature of the charges you are facing, you can be better prepared when you are in the process of selecting a criminal defense lawyer. If you are in need of assistance then contact my office today to speak with an attorney. I have been practicing law since 1995 and I devote my practice to protecting the rights of the accused. I am Board Certified in Criminal Defense by the Texas Board of Legal Specialization and we look forward to speaking with you.

I will be addressing a number of topics over my coming articles. Matters which I will discuss include:

  • Whether a first-time felony offender can receive probation or will they go to prison
  • The handling of state jail felonies
  • Offenses that that result in first-degree felony charges
  • Typical second-degree felony cases
  • What to expect when charged with a third-degree felony
  • Handling capital offenses

I am addressing these topics for a number of reasons. First, Texas felony convictions will often be probationable. A defendant may not receive probation, however, under Texas Code of Criminal Procedure 42A.001, if their sentence is for a period of ten years or longer. Second, understanding the type of conduct that can lead to the various levels of felonies can assist one in understanding why they are facing the charges which have been brought. Third, it is important to discuss the types of defenses which may apply to different situations. Finally, understanding how to select a lawyer for a capital case is vital if your family member is facing the ultimate penalty.

A point I will be making in each of these articles is that you should contact an attorney as soon as possible if you or a family member have been arrested. It is not uncommon for individuals to under-appreciate the gravity of their situation in the beginning. This is especially true if they have never interacted with the criminal justice system before. By retaining experienced counsel, you can increase the chances that your rights are fully protected throughout the process.
